Notice of Privacy Practices

This notice describes how your information may be used/disclosed and how you can get access to your information. Please review it carefully.

About LCBDD
People with developmental disabilities and their families are the center of our work. We partner with people to encourage them to maximize their potential, assume a level of responsibility according to their abilities, and secure their future. We use resources creatively and responsibly to build a community that cares about and contributes to the quality of life of its fellow citizens who have developmental disabilities.

LCBDD Privacy Responsibilities

LCBDD is required by law to:

  • Keep your information private.
  • Provide information about the ways the Board may use/share your information.
  • Create, maintain, and follow a privacy policy.

LCBDD reserves the right to make changes to their policy at any time and make new privacy rules effective for all information it maintains. Any changes can be found on lcountydd.org or can be requested by calling 740-349-6588.

Your Rights

  • You have the right to:
    Request restrictions, in writing, on how LCBDD uses/shares your personal information (all requests will be considered, but the Board is not required to agree to any restrictions). Receive confidential communication of your information.
  • Inspect/copy your information including service/medical/billing records (fees may apply).
  • Request corrections/additions to your information (must provide a reason for the request).
  • Request a record of how LCBDD has shared your info (request made in writing listing the timeframes desired-must be within 6 years of the date requested, first is free but a fee may apply for subsequent).
  • Request LCBDD use a specific phone number for you.
  • Request a paper copy of this notice.
  • Write to the LCBDD Privacy Officer to revoke your authorization to release information (LCBDD may not be able to continue your services).

Your Records

LCBDD keeps records of the services it provides to you. Your Service Coordinator keeps notes on all contacts made while coordinating services, If you see a therapist working for LCBDD, records will be kept of those services as well. LCBDD staff may also share your information amongst each other while developing support plans. Some personal records, including confidential communications with mental health professionals and other specialists, may have additional restrictions for use/disclosure under state/federal laws. If LCBDD staff wish to share your information with anyone is not not employed by the Board, you must first give them written permission via our “Release of Information” form. There are circumstances when LCBDD may be required by law to disclose your information without a release pursuant to HIPAA Administrative Simplification Regulation text 45 CFR § 164.512.

LCBDD may use your personal information for:

  • Determining eligibility for Medicaid (including determining the amount and type of Medicaid services you require) and eligibility for Board services.
  • Billing/obtaining payment for your services provided or other normal business operations from Medicaid, insurance, or other sources.
  • Developing plans to better serve people we support.
  • Improving overall service quality (including staff training, cost management, and activities required to perform Board business duties).
  • Recommending service alternatives and other possible benefits available to you (including communicating information for other services providers who might be able to help you). Facilitating Board reviews of direct service contracts.
  • Monitoring of services by Local/State/Federal agencies.
  • Ensuring waiting lists are kept in accordance with law.
  • Investigating incidents affecting health and safety (including reporting these incidents and taking steps to protect your future health and safety).
  • Preparing reports required by the Ohio Department of Developmental Disabilities, Ohio Department of Job and Family Services, and the Ohio Department of Medicaid. Communication regarding your personal information with your legal guardian (or person representative when an adult individual we support has agreed to let that person obtain information).
  • Other reasons determined appropriate and consistent with your privacy rights
